Each party hereby acknowledges that it has not relied upon any warranty made by the other except as specifically set forth in this agreement.

Xtract has the right to change any portion of the site at any time at its sole discretion. This may include adding or removing features and/or content.

Xtract has provided links to certain third party service providers that provide goods and services that may be of interest to clients. The content of these other web sites in not the responsibility of or under the control of Xtract and therefore, Xtract is not responsible for the content, or its accuracy for any of these other sites. Clients link to these other sites at their own risk.

Xtract has spent considerable time and expenditures to develop the site and services. The Xtract name, trademarks and the valuable intellectual property and all rights with respect to the Xtract services and, whether now existing or which may hereafter come into existence, which are not expressly granted to Client herein, are reserved to Xtract. Any goodwill generated through Client’s use of the Xtract name and trademarks shall inure solely to the benefit of Xtract.

Except as expressly stated in this agreement, client agrees that the Xtract content, or any subset thereof, may not be resold, redistributed, reused, copied, republished, redistributed, altered , edited, retransmitted, or exploited in any manner, for any purpose, without the express prior written consent of Xtract and the written authorization of any data source or third party providing the applicable data.

Due to the inherent unreliability of the internet and computers, Xtract, its affiliates, and its data sources shall have no liability to client or any third party for any loss, expense, or damages relating to reduced performance, accuracy, interruption, or termination of the Xtract services or the Xtract content. Client agrees to hold Xtract, its affiliates, and data sources harmless from and against such loss, expense, or damages based upon any third party claims.
